Users must be at least 13 years old to access and utilize ChattyFic. However, individuals under the age of 13 may use the service with explicit permission from a parent or legal guardian.

Users under the age of 18 must obtain explicit permission from their parent or legal guardian to access and use ChattyFic. It is the responsibility of the parent or guardian to review this agreement with the user. By permitting a user under the age of 18 to access ChattyFic, you agree to be bound by the terms of this agreement and assume responsibility for the user's activities on the platform.

If you are using ChattyFic on behalf of a company or organization, you represent and warrant that you have the authority to bind such entity to this agreement. By accessing or using ChattyFic on behalf of such entity, you agree to be bound by this agreement on behalf of the entity.

The content available on ChattyFic encompasses a variety of materials, including but not limited to graphics, photos, text, branding, and other assets provided by both users and ChattyFic itself. The content uploaded to ChattyFic is the sole responsibility of the individual or entity that submits it to the platform. If you encounter any content that you believe violates the terms of this agreement, please report it to us for review and appropriate action.

Users have the option to read stories and search for content on ChattyFic without requiring a ChattyFic account. However, to access all features and enjoy full functionality, including adding stories to their library, creating, publishing stories, and accessing additional features, a ChattyFic account is necessary.

Our Privacy Policy outlines our commitment to safeguarding your personal data and ensuring your privacy is protected while using ChattyFic.

You are permitted to access and utilize ChattyFic as long as you adhere to the terms outlined in this agreement and comply with relevant laws and regulations. Content on ChattyFic may be viewed for personal, non-commercial purposes.

These are some of the restrictions in place

1. You are not permitted to access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify, or otherwise use any part of the Service or any Content, except: (a) as expressly authorized by the Service; or (b) with prior written permission from ChattyFic and, if applicable, the respective rights holder.
2. You are prohibited from circumventing, disabling, engaging fraudulently with, or otherwise interfering with any part of the Service (or attempting to do any of these actions), including security-related features or features that: (a) prevent or restrict the copying or other use of Content, or (b) limit the use of the Service or Content.
3. Accessing the Service using any automated means, such as robots, botnets, or scrapers, is strictly prohibited.
4. You are not permitted to collect or harvest any information that could potentially identify a person (such as usernames or faces) unless expressly permitted by that individual.
5. Using the Service to distribute unsolicited promotional or commercial content, or engaging in other forms of unwanted or mass solicitations, is strictly prohibited.
6. You are prohibited from causing or encouraging any inaccurate measurements of genuine user engagement with the Service. This includes but is not limited to, paying individuals or providing them with incentives to artificially increase metrics such as read count, likes, or any other form of manipulation of metrics.
7. Users are strictly prohibited from misusing any reporting, flagging, complaint, dispute, or appeals process available on the platform. This includes making groundless, vexatious, or frivolous submissions.

Using the Service does not confer ownership or rights to any aspect of the Service, including user names or any other content posted by others or ChattyFic.

ChattyFic is continually evolving and enhancing its service to better meet the needs of its users. This may involve making changes such as adding or removing features and functionalities, introducing new digital content or services, or discontinuing old ones.

A ChattyFic account provides users with the capability to upload content to our platform. Users may utilize their content to promote their business or artistic endeavors. However, when uploading content, users must ensure that it complies with this agreement and applicable laws. Users are legally responsible for the content they submit to ChattyFic. We may employ automated systems to analyze user content to detect and address infringement and abuse, including spam, malware, and illegal content.

You retain ownership rights in your content but we do require you to grant certain rights to ChattyFic.

By providing content to the service, you grant ChattyFic a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use the content in connection with the service and ChattyFic. This includes the right to promote and redistribute part or all of the service.

The licenses granted by you shall persist for a commercially reasonable period subsequent to the removal or deletion of your Content from the Service. It is acknowledged and agreed that ChattyFic may retain server copies of removed or deleted videos, albeit refraining from their display, distribution, or performance.

You grant ChattyFic the right to monetize your Content on the Service, which may encompass displaying ads on or within Content or charging users a fee for access. It is expressly understood that this Agreement does not entitle you to any payments. In compliance with applicable law, ChattyFic reserves the right to withhold taxes from such payments, if required.

You may remove your content from ChattyFic at any time. You Must remove your content if you no longer have the rights required by these terms.

If any of your Content (1) violates this Agreement or (2) poses potential harm to ChattyFic, our users, or third parties, we reserve the right, at our discretion, to remove or take down some or all of such Content. We will provide notification of the reason for our action, unless we reasonably believe that doing so: (a) would violate the law or the directives of a legal enforcement authority, or would otherwise expose ChattyFic or our Affiliates to legal liability; (b) would compromise an ongoing investigation or the integrity or functionality of the Service; or (c) would cause harm to any user, other third party, or ChattyFic.

If you believe your copyright has been infringed on the service, please send us a notice.

You May stop using ChattyFic at any time.

ChattyFic reserves the right to suspend or terminate your account or access to all or part of the platform's services under the following circumstances: (a) in the event of a material or repeated breach of this Agreement by you; (b) where such action is necessary to comply with a legal requirement or court order; or (c) if there is reasonable belief that your conduct has resulted or may result in liability or harm to any user, third party, or ChattyFic. This provision serves to protect the integrity of the platform and ensure compliance with legal obligations.

If we terminate or suspend your account, we will provide notification with the reason, except under the following conditions: (1) if it involves a violation of law or legal enforcement authority; (2) if it would compromise the integrity, operation, or security of the service; or (3) if it would cause harm to any user, third party, or to the ChattyFic brand. These exceptions are essential to maintain compliance with legal obligations, protect the platform's functionality, and safeguard the well-being of all stakeholders involved.

In the event of termination of your ChattyFic account, all associated content will be purged, and many features will be disabled. However, users will retain the ability to view content without an account. Should you believe that your account was unjustly terminated or suspended, we encourage you to submit an appeal for review.

The service is provided 'AS IS,' except as expressly stated in this agreement or as required by law. ChattyFic does not make any specific commitments or warranties regarding the service. We do not provide warranties about: (1) the content provided through the service; (2) the specific features of the service, or its accuracy, reliability, availability, or ability to meet your needs; (3) the accessibility of any content you submit on the service.

Except as required by applicable law, ChattyFic and its employees will not be held liable for any loss of profits, revenues, business opportunities, goodwill, or anticipated savings; loss or corruption of data; indirect or consequential loss; or punitive damages.

1. Errors, mistakes, or inaccuracies on the service
2. Personal injury or property damage resulting from your use of the service
3. Any unauthorized access to or use of the service
4. Any interruption or cessation of the service
5. Any viruses or malicious code transmitted to or through the service by any third party
6. Any content whether submitted by user or ChattyFic, including your use of content
7. The removal or unavailability of any content

This provision applies to any and all claims, regardless of whether such claims are asserted based on warranty, contract, tort, or any other legal theory.

ChattyFic's total liability for any claims arising from or relating to the service is limited to the greater of: (1) The amount of revenue that ChattyFic has paid to you from your use of the service in the 12 months before the date of your written notice to ChattyFic of the claim, or (2) USD $500.

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ChattyFic and its employees from and against all claims, damages, obligations, losses, liabilities, costs of debt, and expenses (including but not limited to attorney’s fees) arising from: (1) Your use of and access to the service; (2) Your violation of any term of this agreement; (3) Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (4) Any claim that your content caused damage to a third party. This defense and indemnification obligation will survive this agreement and your use of the service.

The Service may include links to third-party websites and online services that are not owned or operated by ChattyFic. ChattyFic has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

We may change this Agreement, for example, (1) to reflect changes to our Service or how we do business - for example, when we add new products or features or remove old ones, (2) for legal, regulatory, or security reasons, or (3) to prevent abuse or harm. If you don’t agree to the new terms, you should remove any Content you uploaded and stop using the Service.

If your use of the service ends, the following terms of this agreement will continue to apply to you: “Extra legal information”, about this agreement, and the licenses granted by you will continue as described under duration of license.

If it turns out that a particular term of this Agreement is not enforceable for any reason, this will not affect any other terms.

If you fail to comply with this Agreement and we do not take immediate action, it does not waive any rights we may have, including the right to take action in the future.

All claims arising out of or relating to these terms or the service will be governed by Florida Law, except Florida conflicts of laws rules.

You and ChattyFic agree that any cause of action arising out of or related to the services must commence within one year after the cause of action accrues. Otherwise such causes of action is permanently barred.
